Safe and secure parking places

Safe and secure parking place means a parking place for commercial users allowing them to avoid unsuitable parking and contributing to safety of drivers and freight (Commission Delegated regulation (UE) 885/2013).

National access to information point

Since July 28, 2022, the new regulation on the levels of service and security that certain facilities must meet to be considered as "safe and protected parking areas" has been in force. For this reason, the General Directorate of Highways has established a transitory period of 6 months, counting from the notification to the owners of the facilities affected by this regulatory change, in which two national access points to the information on safe and secure parking lots:

After said period, the platform that collects the information of the safe and protected parking areas certified in accordance with the Regulation will be maintained exclusively.

Request of inclusion of certified parking areas

The owners of facilities that, having been duly certified by an independent certification body, according to the provisions of Commission Delegated Regulation (EU) 2022/1012 of 7 April 2022, wish the information about their parking areas to be accessible through the National access to information point on safe and secure parking areas can request their inclusion in it by fulfilling the following form:

Accredited certification entities

Only certification bodies and auditors that meet the requirements established in Annex II of Commission Delegated Regulation (EU) 2022/1012 of 7 April 2022 will be authorized to carry out the certification of safe and secure parking areas referred to in article 8 bis section 1 of Regulation (EC) No 561/2006.

Parking operators wanting to be certified in accordance with EU regulation set out in Annex I of Commission Delegated Regulation (EU) 2022/1012 will submit an application to a certification body for it to carry out a certification audit at its facilities. New audits must be carried out every 3 years.

Legal framework

The legal framework that regulates safe and secure parking lots or car parks is made up of:

  • Royal Decree 662/2012 of April 13 establishing the framework for the deployment of intelligent transport systems (ITS) in the field of road transport and for interfaces with other transportation modes which incorporates into the Spanish legal system the Directive 2010/40/EU of the European Parliament and of the Council of 7 July 2010 on the framework for the deployment of Intelligent Transport Systems in the field of road transport and for interfaces with other modes of transport
  • Royal Decree 345/2011 of March 11 on the management of road infrastructure safety in the National Road Network which partially transposes into the Spanish legal system the requirements established in Directive 2008/96/EC of the European parliament and of the council of 19 November 2008 on road infrastructure safety management
  • Regulation (EC) nº 561/2006 of the European Parliament and of the Council of 15 March 2006 on the harmonisation of certain social legislation relating to road transport and amending Council Regulations (EEC) Nº 3821/85 and (EC) Nº 2135/98 and repealing Council Regulation (EEC) No 3820/85
  • Regulation (EU) 2021/1153 of the European Parliament and of the Council of 7 July 2021 establishing the Connecting Europe Facility and repealing Regulations (EU) Nº 1316/2013 and (EU) Nº 283/2014
  • Commission Delegated Regulation (EU) No 885/2013 of 15 May 2013 supplementing ITS Directive 2010/40/EU of the European Parliament and of the Council with regard to the provision of information services for safe and secure parking places for trucks and commercial vehicles
  • Commission Delegated Regulation (EU) 2017/1926 of 31 May 2017 supplementing Directive 2010/40/EU of the European Parliament and of the Council with regard to the provision of EU-wide multimodal travel information services
  • Commission Delegated Regulation (EU) 2022/1012 of 7 April 2022 supplementing Regulation (EC) No 561/2006 of the European Parliament and of the Council with regard to the establishment of standards detailing the level of service and security of safe and secure parking areas and to the procedures for their certification
  • Resolutions of May 20, 2016 and January 19, 2018 of the General Directorate of Roads creating and regulating the Platform or National Point of Access to information on protected and safe parking areas of the Ministry of Public Works, current Ministry of Transport, Mobility and Urban Agenda, and a procedure is established to request the inclusion of parking areas in said platform, in accordance with the requirements established within the framework of the European Label project.
  • Resolution of December 20, 2022 of the General Directorate of Roads, by which the necessary requirements are adapted for the inclusion of safe and protected parking spaces in the National Point of Access to information on protected and safe parking areas in accordance with the provisions of Delegated Regulation (EU) 2022/1012, of April 7, establishing a transitional period for the regularization of those facilities that were certified in accordance with the requirements established within the framework of the European Label project.
